PERSONAL DATA PROTECTION POLICY

1.1. Data Controller

Hive (Prometheus Technology Inc) (hereinafter referred to as “HIVE”) will be the sole entity responsible for the processing, use, storage, and disclosure of your personal data, in accordance with the provisions of this Privacy Notice. HIVE guarantees the fundamental right to the protection of personal data of its users (users) through proper handling, within a framework that respects other fundamental rights recognized by law.

Thus, any information about individuals that identifies or makes them identifiable, as well as any form of processing (collection, recording, organization, storage, preservation, modification, consultation, use, transfer, etc.), will be protected by technical, organizational, and legal measures that ensure data security. This is in compliance with applicable security requirements and the regulations governing the matter, including Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), the primary federal privacy law in the private sector.

The user who accesses, browses, or uses Hive (Prometheus Technology Inc) will hereinafter be referred to as the “User.” Hive (Prometheus Technology Inc) provides users with online product delivery and courier services through Hive (Prometheus Technology Inc), based on the user’s needs. These services involve real-time online and offline information interaction and effective adaptation of offline resources through the analysis of large amounts of data (hereinafter referred to as the “Services”). The user who accesses, browses, or uses Hive (Prometheus Technology Inc) as a driver will hereinafter be referred to as the “Delivery Driver.” The driver assigned to transport products through Hive (Prometheus Technology Inc) will hereinafter be referred to as the “Assigned Driver.”

This Privacy Notice of Hive (Prometheus Technology Inc) (hereinafter referred to as the “Privacy Notice”), together with the Terms and Conditions of Use of Hive (Prometheus Technology Inc), establishes the basis for the collection of Personal Information.

Please read this Privacy Notice carefully, understand it fully, and accept it before using the service. If the user does not agree with any part of this Privacy Notice, they must immediately stop using Hive (Prometheus Technology Inc). By using Hive (Prometheus Technology Inc), the user agrees that Hive (Prometheus Technology Inc) may collect, disclose, store, use, process, share, transmit, and protect the User’s Personal Information in compliance with this Privacy Notice.

1.2. Personal Data Collected by the Application

a. User’s Personal Information
The personal data requested by Hive (Prometheus Technology Inc) through the application includes:

• Mobile phone number,
• Name.

b. Information Provided by the User
The user may provide, among other information:

• A photograph by accessing the camera to take a photo or selecting an image from their phone’s photo gallery. These data are optional and are used to help the driver identify the user more quickly when providing the service.
• If the user changes their phone or re-enters the application, it will automatically download their profile photo and save it to the memory of the new device. This requires the application to have permission to write to the phone’s memory, with the goal of saving the user’s internet usage and displaying the downloaded photo from the memory.

c. Location
Hive (Prometheus Technology Inc) collects the user’s location information. The application obtains the user’s location through AGPS, GPS, and other sensors that provide relevant information to improve the Services. This information is essential for providing the correct service. The user agrees to grant background location permissions, even when the application is not open.

d. Trips (Service Provided by Hive (Prometheus Technology Inc))
Hive (Prometheus Technology Inc) collects information about the user’s trip starting point, destination, route, duration, and distance. This information is necessary for the proper functioning of the ride service and to assign a driver and vehicle near the user’s trip starting point. Additionally, this information is stored to resolve any disputes related to the service provided by Hive (Prometheus Technology Inc).

e. Technologically Obtained Data
The following data may be obtained without the user explicitly providing it:

• Information about the phone’s status and characteristics to verify that the necessary permissions for the app are correctly configured.
• Read and write access to the phone’s memory, allowing temporary data storage when internet connection is lost. This data is resent once the connection is restored, and error logs are also stored.
• Model, brand, operating system, and characteristics of the user’s mobile phone, tablet, or device.

f. Data Shared by the User
The user may share their location and trip information with others, including emergency contacts, through Hive (Prometheus Technology Inc)’s services. This includes data such as name, trip route, arrival time, and distance. The user may also share this information through other messaging applications, exposing the same data. It is the user’s responsibility to manage this sharing.

Information shared with the delivery driver includes the user’s name, photo, rating, pickup and drop-off locations, number of trips, fare offered, reviews, and contact information.

1.3. Methods of Obtaining Personal Data

Hive (Prometheus Technology Inc) obtains personal data directly from users who download the application through the app store. If the mandatory personal data is not provided, a commercial relationship cannot be established, and HIVE will be unable to fulfill the offers available on its virtual platform.

2. USE OF PERSONAL DATA

The personal data held by Hive (Prometheus Technology Inc) will be managed and processed for the following purposes, which are strictly necessary for the fulfillment of the commercial relationship between the user and Hive (Prometheus Technology Inc) and for the use of the Application in accordance with its functionalities.

The user agrees to accept and provide free, prior, express, unequivocal, and informed consent for the processing of their personal data collected through the application for the following purposes:

• Measure the quality of services provided by users;
• Properly channel service requests;
• Analyze and evaluate user characteristics and compliance;
• Monitor the proper fulfillment of services;
• Address any complaints, questions, or comments from the user;
• Share location and information with Hive (Prometheus Technology Inc) to determine the user’s location within the city;
• Improve the quality of the Application and Hive (Prometheus Technology Inc)’s services;
• Send notifications related to modifications made to this Privacy Notice.

Additionally, where applicable, the user agrees to the processing of their personal data for the following purposes:

• Statistical purposes;
• Addressing user inquiries or complaints;
• Notifying users via email about benefits and agreements offered by the company.

3. Use of Personal Data for Advertising Purposes

In addition to the above, the user’s identification data may be used to send notifications, notices, or advertising about agreements or promotions to Hive (Prometheus Technology Inc) users.

4. Authorization for the Use of Personal Data

If the user does not wish to authorize the use of their personal data for the purposes outlined in sections 1 and 2, they may revoke their consent at any time by sending an email to: customer_services@prometheustechnologyinc.com.

5. Purpose of Personal Data

The personal data collected will form part of a customer database.

6. Recipients of Personal Data and Cross-Border Data Transfers

Hive (Prometheus Technology Inc) informs users that their personal data may be transferred and processed both within and outside Canada for the purposes outlined in this section. Specifically, personal data is shared internationally with Amazon Web Services Inc. (800 N. Virginia Street, Virginia, USA) and Google LLC (1600 Amphitheatre Pkwy, Mountain View, CA 94043, USA) for cloud storage and file management purposes.

7. Data Processors

Hive (Prometheus Technology Inc) maintains relationships with third-party companies to provide the services requested or contracted by customers and users of the platform. These include:

• Amazon Web Services, with servers located in the USA, for customer data storage and trip creation.
• Google LLC, with servers located in the USA, for email services and storage.

8. Personal Data Security Measures

Hive (Prometheus Technology Inc) will adopt all legal, organizational, and technical security measures established by applicable legislation to safeguard users’ personal information. In cases where third parties require access to this information as part of the commercial relationship, Hive (Prometheus Technology Inc) will ensure proper handling of personal data in accordance with this Privacy Policy.

9. Exercise of Access, Rectification, Opposition, and Cancellation Rights (ARCO Rights)

Users have the right to access, rectify, oppose, or cancel their personal data held in Hive (Prometheus Technology Inc)’s customer database. To exercise these rights, users must send a request to: customer_services@prometheustechnologyinc.com. The request must include:

• Full name and address for response purposes;
• Copy of identification or other document proving identity;
• Clear description of the personal data and the specific right being exercised;
• Date and signature of the applicant;
• Any additional documents facilitating the location of the data.

Hive (Prometheus Technology Inc) will respond within a maximum of 10 natural days or the legally permitted timeframe, which may be extended for justified reasons.

10. Validity and Modifications to the Privacy Policy

Hive (Prometheus Technology Inc) reserves the right to modify the terms and conditions of this Privacy Notice. Any changes will be published on the Hive (Prometheus Technology Inc) website: https://prometheustechs.com/site/policy and/or the application. Users are advised to review the Privacy Policy regularly to stay informed of updates.

11. Deletion of Personal Data

Hive (Prometheus Technology Inc) will delete personal data collected through its application upon user request. Users may request deletion via:

1. The application menu by contacting the company directly.
2. Sending an email to customer_services@prometheustechnologyinc.com with the subject “ACCOUNT AND PERSONAL DATA DELETION.” The email must be sent from the registered email address and include a contact number for verification. Deletion will be completed within 30 natural days of the request.

12. OPTIONS AND TRANSPARENCY

Hive (Prometheus Technology Inc) allows users to access or control the data it collects through:

• Privacy settings,
• Device permissions,
• In-app rating pages,
• Marketing options.

Users may also request access to or copies of their data, make changes or updates to their accounts, or request account deletion or restriction of data processing.

Privacy Settings

Through the Settings > Privacy menu in the Hive (Prometheus Technology Inc) app, users can configure or update their preferences regarding location data collection and sharing, as well as notifications.

• Location Data Collection: Users can enable or disable the collection of precise location data, which is necessary for the app’s proper functioning.
• Notifications: Users receive trip alerts and updates, which cannot be disabled but can be customized in the Settings > Privacy menu.
• Device Permissions: Users can manage permissions for camera, storage, and internet access through the Settings > App Permissions menu.

Changes to the Policy

Hive (Prometheus Technology Inc) may update this policy periodically to reflect changes in laws or service delivery practices. Users will be notified of updates through the “Last Updated” date at the top of this page. Continued use of Hive (Prometheus Technology Inc) constitutes acceptance of the updated policy.

Acceptance

By clicking “Accept” in the application, the user agrees to the terms and conditions of this Privacy Notice. If the user proceeds with registration without accepting the policies, the application will cease to function upon closure, and all data will be deleted. A new registration will be required, accepting Hive (Prometheus Technology Inc)’s Privacy Policy.
